SASU IMPAKT distributes“Mouvements Phénix” brand products.

ORDER

The sending of the order by the customer implies his acceptance of the present general conditions.
The customer places his order in accordance with the specifications appearing on the site.
Any order validated by the customer will only be considered effective by SASU IMPAKT after :
○ Validation of payment by credit card, if payment is made by credit card.
○ Receipt and acceptance of the cheque by the bank, if payment is made by cheque.
○ Notice of receipt of a bank transfer from our bank, if payment is made by bank transfer.

SASU IMPAKT reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. In order to verify the information provided by the customer when placing an order on the mouvements-phenix.com website, our customer relations department reserves the right to ask the customer by telephone and/or e-mail for one or more supporting documents (copy of identity card, receipt from the bank in the case of a transfer that is late in arriving).

This request will have the effect of suspending the order pending transmission of these supporting documents:

SASU IMPAKT may also cancel the order in the event of non-conformity of the supporting documents or failure to transmit such documents.

PAYMENT

Except in special cases specified on a case-by-case basis for certain businesses, all products ordered must be paid for before dispatch.
A deposit of 50% may be requested when the order is placed.
The balance will always be paid before the goods are dispatched.

PRICES

The prices of the products present on the Mouvements Phénix site are prices exclusive of tax and do not include VAT or delivery charges, the latter being at the customer’s expense, in accordance with what is indicated under the heading“DELIVERY“. They are invoiced on the basis of the prices indicated on our site during the validation of the basket at the time of registration of the order.

RENTAL

For the rental of certain products, a deposit will be required in order to guarantee the correct return of the products rent.
The value of this deposit will be determined on a case-by-case basis by SASU IMPAKT.
There will be two possibilities for its form:

  • By bank cheque.
    In this case, the cheque, made out to SASU IMPAKT, must be sent to the company’s head office before the product is dispatched.
    It will not be cashed and will be returned after the return of the goods.
  • By bank transfer.
    In this case, the sum must be paid into SASU IMPAKT ‘s bank account by the customer.
    This sum will be refunded after the return of the goods.

The choice of payment method will be determined by SASU IMPAKT according to the geographical location of the customer’s registered office.
If there is a dispute after the return of the rented goods, an agreement will have to be found between SASU IMPAKT and the customer.
If this agreement is not possible, only the Commercial Court of Romans will be able to settle this possible dispute.

PROVISION AND DELIVERY

Conditions

Deliveries are made worldwide from France. Delivery charges are payable by the customer and are automatically indicated to the customer when they complete their order.

Availability

Product availability is indicated under the photo and price of the item. This period is indicative and may be different depending on the state of our stocks.

In the event of unavailability of the product ordered, the estimated restocking time is indicated at the time the order is placed. SASU IMPAKT shall not be held liable for the unavailability of a product, nor shall it entitle the customer to claim damages.

When a product is available, it is dispatched within ten days of the order being placed. During holiday periods, this period may be up to three weeks.

→ Transfer of risk

Delivery is deemed to have taken place when the goods ordered are made available to the customer by the carrier. This is evidenced by the carrier’s receipt.

The products ordered travel at the sender’s risk; in the event of damage, it is therefore the buyer’s responsibility to make all the necessary observations and return the goods to the sender in accordance with the procedure described below.

→ Complaints and returns

Upon delivery of their order, customers must ensure that the products are in good condition. If the products delivered do not comply in nature or quantity with the specifications indicated on the delivery note attached to the shipment, or have suffered damage during transport, the customer must:

1. Fill in the delivery note legibly stating any reservations and indicating any damage due to transport.
2. Enclose this document with the product in its original packaging, together with the relevant documents.
3. Send everything to SASU IMPAKT within 3 days.
4. The choice of return method will be specified by SASU IMPAKT.
5. If the problem proves to be correct, SASU IMPAKT will reimburse the return costs.
6. The customer will then be promptly contacted by SASU IMPAKT and again delivered free of charge for any available product.
7. After this period of three days, the customer will have to return the product to SASU IMPAKT at his own expense to request an exchange, which will be free of charge for any available product.
8. Whatever the problem reported, under no circumstances will it entitle the customer to a refund of the product.

→ Return or exchange

Unless there is a written agreement between the customer and SASU IMPAKT, no product will be exchanged or taken back.
If there is an agreement for return or exchange, in all cases, the customer must return the product at his own expense to SASU IMPAKT.
Upon receipt of the said product, an analysis will be carried out by SASU IMPAKT which will confirm the condition of the returned product and which will estimate the trade-in value of this product.
After agreement from the customer, SASU IMPAKT will deduct the trade-in value from the product to be delivered in exchange or will send a transfer to the customer’s account to close the deal concerned.

ONE-YEAR GUARANTEE AND TELEPHONE ASSISTANCE

SASU IMPAKT undertakes to provide after-sales service for the products purchased. The customer therefore benefits from a one-year guarantee for all products.
In order to benefit from the guarantee, the customer must return the defective or questionable products to the premises of SASU IMPAKT. The cost of returning the products shall be borne by the customer and shall be refunded if the problem is real, if the customer so requests.
Once the products have been checked or repaired, they will be returned by SASU IMPAKT. SASU IMPAKT is responsible for the cost of returning the products to the customer.
Damages of external origin or consecutive to misuse or mishandling are excluded from the warranty.
During the guarantee year, the customer may call the telephone assistance service to obtain advice on operation or use.
This guarantee consists of a repair or exchange of all or part of the product. No refunds will be made.

If the user dismantles the product beyond the use for which it was sold, the product warranty will lapse.
If, after this hypothetical dismantling, the customer sends the product back for repair or to be put back into operation, the work in question will be invoiced to him, as well as the return postage.

COMMISSIONING

The Customer is responsible for commissioning the products received.

RESPONSIBILITY

SASU IMPAKT shall not incur any liability for any damage or costs arising from the use or inability to use the product.

RETENTION OF TITLE CLAUSE

It is agreed that the goods delivered and invoiced to the customer remain the property of SASU IMPAKT until full payment of their price.
Failure to pay may result in the goods being reclaimed.
The above provisions do not preclude the transfer to the buyer of the risks of loss or deterioration of the goods as well as any damage that may be caused.

LICENCE AND EXPLOITATION RIGHTS

The presentation and content of this site are protected by international conventions and laws on intellectual property, in particular copyright, unfair competition and trademarks. Any networking, redistribution, reproduction or representation in any form whatsoever, in whole or in part, is expressly prohibited without the prior written consent of SASU IMPAKT.

DISPUTES AND LITIGATION

Any dispute may only be settled by the Commercial Court of Romans sur Isère.
No other court may be used.
